The proposed site for the new Derby middle school northeast of 63rd Street and Rock Road will meet state requirements regarding its proximity to a retail liquor store near the same intersection.
Rock Liquor, at 8000 E. 63rd Street South, will be approximately 1,000 feet south the proposed site for the new middle school, said Tom Snodgrass, director of operations for Derby Public Schools.
A Kansas statute states all licensed retail liquor stores must be a minimum of 200 feet from all public schools, colleges and churches. The distance is measured in a straight line from the outside wall of the premises to the nearest property line of the school or college.
The same statute also states that a licensed retail liquor store can be within the 200-foot limit if it predates the school or college.
"With the tight budgets right now, why is the world are think of building a new middle school. The old one has worked for students since 1959. Come on people, stop spending money that you don't have."
